What it asks

Lawyers using generative AI must protect client confidences, supervise the tools and stay alert to conflicts, under the existing Model Rules.

Each agent acts as the lawyer who asked and reads only that lawyer's matters. Identifiers are stripped before a model call, and the audit record shows what each agent read.

Privilege after United States v. Heppner

What it asks

In 2026 the S.D.N.Y. found no privilege for material made with a public AI tool, and left room for enterprise tools with confidentiality terms.

What Dome gives you

Agents reach only the models the firm approved, through one gateway, with client data redacted. Public tools aren't in the path.

Ethical walls (Model Rules 1.7, 1.9, 1.10)

What it asks

Screened lawyers must be kept away from a matter, and the firm must be able to show it.

Common questions

Does using AI waive attorney-client privilege?

Courts have started to say it can. In United States v. Heppner (S.D.N.Y. 2026), material made with a public AI tool wasn't privileged; the court noted enterprise tools with confidentiality terms may differ.

How do ethical walls work with AI tools?

The agent carries the identity of the lawyer who asked, and a rule checks that lawyer's matter access before every read. A walled lawyer's agent is refused the same way the lawyer would be.

What does ABA Formal Opinion 512 require?

It applies the existing Model Rules to generative AI: competence, confidentiality, communication, supervision and reasonable fees. It expects firms to understand and control the tools they use.

Can AI agents send documents to clients?

Not on this setup. The redline agent saves drafts to iManage and is refused when it tries to create a DocuSign envelope.
